The core tasks of the consultant will consist of clarifying the parameters to be taken into account when calculating the compensation for the generic drug in question. Key Deliverables
- Key deliverable will be the estimated number of years needed to rebuild a lost customer base.
- Document well the methods used to determine the economic ‘damages’, as afterwards questions and/or objections from the involved parties need to be responded to.
- Help the financial expert calculate the replacement cost of the failed API for the period in question.
- Ideally the consultant should have access to IQVIA market data and have intricate knowledge on how to interpret these data and carry out a preliminary analysis.
- Be able to critically review the financial expert’s conclusions before communicating them to the involved parties.
- Good understanding and insight in the intricacies of P&L in pharma and pharmaceutical generics in particular: fixed costs, variable and semi-variable costs, and usual margins, as it is a matter of calculating lost profit.
Overall, the aim is to help a financial expert, assigned by a Belgian court to calculate the compensation that an API supplier should pay to a pharmaceutical company for failing to deliver the contracted quantities of a specific generic drug.
The estimated duration of the consultancy is between 10 and 20 hours, and the payrate for the consultant is fixed at 150€/hour. The number of hours could be substantially higher, if parties involved have a lot of additional questions. These hours are likely to be spread over a long period of time, due to the slow processes within the justice system
The next meeting with the two parties and their technical experts is scheduled for February 17, 2026, in Brussels. The consultant would likely accompany the financial expert at this meeting. The choice of the consultant will have to be submitted to and approved to the parties, before the hours performed can be effectively billed.
